Peaceful Settlement of International Disputes

  1. The UN Charter has outlawed use of force as a means of settlement of international disputes.
  2. However, there is no obligation under international law to settle disputes.
  3. Procedure of international disputes is dependent upon the consent of the states.
  4. Settlement of international disputes also takes place by means of political organs like UNGA, UNSC etc.
  5. Traditionally, states have chosen negotiation, good offices, and mediation as informal methods of peaceful settlement of international disputes.
  6. Particularly, inter state arbitration has played an important role in the settlement of international disputes. Since Alabama Claims arbitration of 1872, inter state arbitration grew as a significant instrument for the settlement of international disputes.
  7. Modern means of settlement of international disputes are characterized by the rise of international courts and tribunals, specialized tribunals and arbitration etc.
